Terms of Service — Visa India Online MCP Connector

These terms govern your use of the Visa India Online Model Context Protocol (“MCP”) connector. They apply only when an AI assistant (such as Claude, ChatGPT, or Gemini) calls our tools on your behalf. They do not govern the Visa India Online application website, which has its own terms at {WEBSITE_TERMS_URL}.

By invoking the connector through your AI assistant, you agree to these terms.

1. What the connector does

The connector exposes two tools to AI assistants:

• check_visa_eligibility — given a passport country and destination, returns whether the destination requires a visa for that nationality and the current rule decision.
• list_visa_packages — given a passport country and destination, returns the available visa packages with prices, processing times, and a deep link to start an application on the Visa India Online website.

Both tools return information based on rules and pricing maintained by Visa India Online for the destinations it supports. The connector does not submit visa applications, accept payments, or store user-supplied documents — those happen on the Visa India Online website only after you click an apply link.

2. We are not a government

Visa India Online is an independent visa facilitation service operated by {OPERATOR_LEGAL_NAME}. We are not affiliated with any government agency. We do not issue visas. Visa decisions are made solely by the relevant government authority of the destination country.

3. Information, not legal or immigration advice

Tool responses are informational. They reflect the rule and pricing data we hold at the time of the query and are intended to help you understand whether a visa product exists for your nationality + destination combination. Responses are not legal advice and not immigration advice. They do not guarantee approval, do not guarantee any specific processing time, and do not guarantee that the rule we hold matches the position the destination’s government will take at the moment you actually travel.

If you have a complex case (overstays, prior refusals, criminal record, dual nationality, statelessness, official travel, journalism, etc.), consult a licensed immigration professional in addition to using the connector.

4. Accuracy and timeliness

We make a reasonable effort to keep eligibility rules and prices current. We do not warrant that the data is complete, accurate, or up to date at every moment. Government policy can change without notice; published prices can change; the destination’s authorities are the only authoritative source. If a rule appears wrong, please tell us at support@visain.in so we can investigate.

5. Apply links

The list_visa_packages tool returns deep links to the Visa India Online application website. Clicking a link is voluntary. The application form, document upload, and payment are governed by the website terms at {WEBSITE_TERMS_URL} and the website privacy policy at {WEBSITE_PRIVACY_URL}.

6. No warranty

The connector is provided “as is” and “as available”. To the maximum extent permitted by applicable law, Visa India Online disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of liability

To the maximum extent permitted by applicable law, Visa India Online, {OPERATOR_LEGAL_NAME}, and their officers, employees, agents, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or in connection with your use of the connector or your reliance on any response returned by the connector — even if we have been advised of the possibility of such damages.

Our total cumulative liability for direct damages arising out of or related to the connector will not exceed one hundred Euros (EUR 100), or the equivalent in your local currency.

Nothing in these terms limits or excludes any liability that cannot be limited or excluded under applicable law.

8. Acceptable use

You may not use the connector to:

• Attempt to bypass authentication, rate limits, tenant isolation, or other access controls.
• Submit volumes of automated requests that would interfere with service for other users.
• Probe for, scan, or test vulnerabilities except via responsible disclosure to support@visain.in with subject line SECURITY.
• Use the responses to mislead other people about visa requirements (e.g. presenting our data as a government determination).

9. Changes to the service or these terms

We may modify the connector or these terms. Material changes will update the effective date above. Your continued use after the effective date of a change constitutes acceptance of the change.

10. Governing law and venue

These terms are governed by the laws of Portugal, without regard to conflict-of-law principles. Disputes arising out of or relating to these terms or the connector will be brought exclusively in the courts of {PORTUGUESE_VENUE} (typically Lisbon, or the operator’s registered seat), except where a mandatory consumer-protection rule of your country of residence would otherwise apply.

TODO (legal review): confirm Portuguese governing-law selection with counsel before submission. {OPERATOR_LEGAL_NAME} is being registered in Portugal (per project context), which is the working assumption here. If the operator entity is established elsewhere by submission time, update the jurisdiction accordingly.
